TERMS & CONDITIONS
These Terms & Conditions apply to all services provided by Fine Tuned Muse, Simi Pannu Pilates, and Fine-Tuned of Ontario, Canada.
These Terms & Conditions govern the sale of any online membership, course, and/or taught program. Please read them carefully before making a purchase.
By clicking the “Accept” button on our website, you agree to be bound by these Terms & Conditions. If you do not agree, you must not proceed with any purchase of our services.
Sales Policy
All purchases on fine-tuned.ca, its app, or through Apple or Google Play are subject to the following terms. We encourage all customers to review them carefully before purchasing.
Each PDF download, online content, and workout program is licensed to a single user only. Customers may not copy, distribute, share, or transfer purchased products to any third party.
All purchases are non-refundable and non-transferable, including payments for courses, memberships, class packages, and retreat deposits. Specifically:
Class passes are non-transferable and non-refundable.
Private session packages are non-transferable, non-refundable, and must be used within three (3) months of purchase.
Because all products and services are digital and intangible, we cannot accept refund requests. If you believe a purchase was made in error, please contact us at hello@finetunedmuse.com to discuss a resolution.
For refund or transfer requests related to class packages or courses purchased through third-party studios, please contact that studio directly.
By placing an order, you confirm that you are at least 18 years of age (or have parental permission to purchase) and that you accept these Terms & Conditions.
Payments
All transactions are processed by trusted third-party payment providers to keep your information secure. Payments are handled by Shopify, Stripe, PayPal, and/or your app subscription platform. Fine Tuned Muse, Simi Pannu Pilates, and Fine-Tuned do not store your credit card information. Please review the terms and conditions of Stripe, PayPal, Shopify, Apple, and Google, as applicable, as those platforms are responsible for processing your transactions.
Safety Disclaimer
Physical exercise, with or without equipment (such as blocks or straps), is a strenuous activity. We strongly encourage you to consult a physician before beginning any exercise program or using any equipment featured on this website. Fine Tuned Muse, Simi Pannu Pilates, and Fine-Tuned are not medical organizations and cannot provide medical advice or diagnosis. Nothing on this website should be interpreted as medical advice.
By using this website, you acknowledge that physical exercise carries inherent risks, including the risk of physical or mental injury. You accept full responsibility for assessing your own physical and mental capabilities, selecting an appropriate level of participation, and ensuring you do not exceed your limits. You expressly waive and release any claim for injury against Fine Tuned Muse, Simi Pannu Pilates, Fine-Tuned, and any associated directors, principals, instructors, contractors, employees, agents, and representatives.
When participating in any Fine Tuned Muse, Simi Pannu Pilates, or Fine-Tuned class or program, please ensure you always:
Have sufficient space to practice safely
Check for trip and slip hazards in your area
Remove any objects you could fall on or come into contact with
Ensure there are no sharp objects or hot surfaces nearby
Have adequate lighting in your space
Place cameras, screens, and electrical cables outside your training area to avoid trip hazards
Ensure the room is properly ventilated
Have water available to stay hydrated
Seek medical advice before training if you have any existing injuries or medical conditions
Ensure children are supervised by an adult at all times
Inform all household members of your training and ask them not to enter your space
Limitation of Liability
To the fullest extent permitted by law, Fine Tuned Muse, Simi Pannu Pilates, and Fine-Tuned, including their officers, directors, employees, and agents, shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from:
errors, mistakes, or inaccuracies in website content;
personal injury or property damage resulting from your access to or use of the website;
unauthorized access to our servers or any personal or financial information stored therein;
interruptions or cessation of transmission to or from the website;
bugs, viruses, Trojan horses, or similar issues transmitted through the website by third parties; or
errors or omissions in content, or any loss or damage resulting from content posted, emailed, transmitted, or otherwise made available via the website.
Fine Tuned Muse, Simi Pannu Pilates, and Fine-Tuned are not responsible for content posted by users or for defamatory, offensive, or illegal conduct by third parties. References to any person, entity, product, or service on this website do not constitute an endorsement. We are not responsible for any third-party content on or linked from this website, nor do we warrant the accuracy of any information on third-party websites. We reserve the right to remove any material posted on the website that we determine, in our sole discretion, violates any law or the rights of any person.
Return Policy
Because all of our products are digital, they are considered “used” upon purchase or download. For this reason, we have a strict no-refund policy.
You may cancel your subscription at any time and will retain access to your subscription through the end of your current billing period (monthly, quarterly, or annual). WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL BILLING PERIOD OR FOR UNWATCHED CONTENT.
Billing Cycle
Your membership fee is billed at the start of your paid membership and on the same calendar day each subsequent month, quarter, or year, unless you cancel. Membership fees are fully earned upon payment.
We reserve the right to adjust the timing of billing where necessary. If your billing start date falls on a day that does not exist in a given month, we will bill on the nearest applicable date. For example, if your membership began on January 31st and you pay monthly, your next billing date may be February 28th.
Free Trials
(a) We may offer a free trial subscription for a set period of time, at our sole discretion.
(b) Unless stated otherwise, free trials are available to new users only. We reserve the right to cancel any trial if we determine that the subscriber has previously held a trial on a different account or email address. Attempting to register for an additional free trial on the same account or email address may result in charges for the applicable subscription fees.
(c) If your subscription begins with a free trial, your payment method will be charged at the end of the trial period unless you cancel before the trial ends.
Cancellation
All memberships auto-renew. To avoid being charged for the next billing cycle, you must cancel at least 48 hours before your renewal date. This is standard practice for subscription-based services (similar to Netflix, Amazon Prime, Apple, and Google subscriptions).
You may cancel your membership at any time and will continue to have access through the end of your current billing period. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL BILLING PERIOD OR FOR UNWATCHED CONTENT.
Fine Tuned Muse, Simi Pannu Pilates, and Fine-Tuned reserve the right to amend any information, including prices, technical specifications, terms of purchase, and product offerings, without prior notice.
Technology
You are responsible for ensuring you have the necessary technology to access and use our online programs. Refunds will not be issued due to technical issues on your end. We recommend previewing our sample videos and downloading sample documents before purchasing if you have any concerns about your device’s compatibility. We are not liable for any technical issues beyond the delivery of our own website.
Inherent Risks
You understand that participating in this program — which may involve physical exercise and dietary changes — carries inherent risks. These include, but are not limited to: dizziness, fainting, nausea, physical discomfort, musculoskeletal injuries (such as muscle tears), cardiovascular events (such as irregular heartbeat, heart attack, or death), injury to a fetus if pregnant, and other exercise-related injuries, regardless of whether caused by your own actions, those of others, or the negligence of the online instructor. Risks also include discomfort or illness resulting from dietary changes or new foods.
You understand these risks may result in serious physical or mental harm, significant changes to your quality of life, or, in extreme cases, death. If you have any concerns about your health or ability to participate, we strongly urge you to consult your doctor immediately. Listen to your body, take things slowly, and make modifications where needed. By agreeing to these Terms & Conditions, you confirm you are in good general physical and mental health and able to exercise and adjust your nutrition at the time of joining.
Medical Disclaimer
Fine Tuned Muse, Simi Pannu Pilates, and Fine-Tuned provide online workouts and coaching only. Your participation does not create a patient-healthcare-provider relationship. Our instructors are not acting as registered healthcare professionals. Each participant must listen to their own body and follow the guidance of their own healthcare provider.
We strongly advise you to consult your doctor before beginning any membership. It is your responsibility to regularly check in with your doctor and monitor how your body responds, in order to determine the appropriate level of participation. By joining, you confirm that you have taken the necessary precautions and are healthy enough to participate.
Voluntary Assumption of Risk
By accepting these Terms & Conditions prior to purchase, you confirm that you have read and understood the risks outlined above and that you voluntarily consent to participate in the membership. You further confirm that you have the full capacity to do so.
No Warranty
Fine Tuned Muse, Simi Pannu Pilates, and Fine-Tuned make no promises or guarantees that you will achieve a specific weight, strength level, energy level, or relief from any ailment. All services provided through the online membership are offered without any express or implied warranties.
Release, Waiver, and Indemnity
In consideration of being permitted to participate in the membership, you hereby release Fine Tuned Muse, Simi Pannu Pilates, Fine-Tuned, and their agents, employees, contractors, heirs, executors, administrators, successors, and assigns from any liability arising from services provided, including physical or financial damages, personal injury or death, or injury or death to a fetus if pregnant — however caused, including through negligence — during your participation.
You understand that you are releasing these parties from liability at your own risk and that you forfeit all legal recourse, including any form of damages, as a result of your participation. These provisions apply to you, your family, heirs, executors, and any other party who may bring a legal claim on your behalf.
You agree to indemnify and hold harmless Fine Tuned Muse, Simi Pannu Pilates, Fine-Tuned, and their agents, employees, contractors, heirs, executors, administrators, successors, and assigns from any and all liability for damages, financial loss, personal injury, or injury to a fetus if pregnant, resulting from your participation in the program.
Intellectual Property / Copyright
All intellectual property rights in the program materials, online programs, and any content delivered through taught programs remain the exclusive property of Fine Tuned Muse, Simi Pannu Pilates, Fine-Tuned, or their licensors, whether or not customized for the client.
You are not permitted to:
copy, modify, reproduce, republish, sublicense, sell, upload, broadcast, post, transmit, or distribute any program materials without prior written permission;
(viii)record, relay, or transmit any online or taught program by video, audio, or any other means;
use program materials in connection with any other program or training, whether delivered by us or a third party;
remove any copyright or proprietary notice from program materials; or
modify, adapt, translate, disassemble, decompile, or reverse-engineer any software forming part of the online programs (except where permitted by law).
Any breach of the above will entitle us to immediately terminate your access to services, including all online programs.
In consideration of the fees paid, we grant you a limited, non-transferable, non-exclusive licence to use the program materials solely for the purpose of completing the online program and/or attending the taught program.
Law and Jurisdiction
These Terms & Conditions are governed by Canadian law. Any disputes arising under this agreement will be subject to the exclusive jurisdiction of the Canadian courts.
